Terms of Service and Use
This user agreement (“Agreement”) establishes the terms under which you are permitted to use our website and its associated services including nurse advocate services, NFSA business model/kit. Use of this website and business model/kit, signifies that you have read, understand, and accept all terms and conditions herein. By accessing the service model, you represent that you have legal authority to accept the terms on behalf of yourself, your nursing profession, your child, or your business. This means that you are at least 18 years of age. If you do not or cannot agree to these terms, you are prohibited from using the website or accessing our nursing services.
Modifications
Nurses For Safe Access in Blue Jay, California may modify this agreement from time to time, without notice, other than posting the amended agreement on the site. You accept any modification by using our professional services after the modifications have become effective.
User Conduct
You agree to use our site and our professional services in a manner consistent with all applicable laws and regulations in your jurisdiction. You may not use our site in any manner that:

You may not copy, use, or replicate these elements without written permission. Nurses For Safe Access also reserves all rights in its trademarks. Other trademarks or trade names on the site are the property of their respective owners, which may or may not directly be affiliated with Nurses For Safe Access.
Limitation of Liability
Nurses For Safe Access is not liable for any content, links, advertisements, site malfunctions, professional coaching, misdirections, or any other events that may inconvenience or harm a user’s interests. Nurses For Safe Access cannot exercise any control over third-party networks it may link to.
Nurses For Safe Access is not liable for the recommendations, dosing, product delivery methods, or information provided by the independent nurse advocates provided on this site or the independent nurse applicant working under our branding.
Except to the extent required by applicable law and then only to that extent, in no event will Nurses For Safe Access, its employees, contractors, officers, directors, affiliates, or agents be liable to you, or your relatives on any legal theory for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including without limitation, loss of life, pain and suffering, emotional distress, revenue or income, lost profits, cost of substitute goods or services, or similar damages suffered or incurred by you, your relatives, or any third party that arise in connection with the website, training, or our services.
Disclaimers
All facts, details, and recommendations on the Nurses For Safe Access website or from the independent nurse advocates are provided for informational purposes only and are not intended to diagnose, treat, prescribe, or replace the advice of professional physician(s).
Our recommendations are based on the advice of licensed medical professionals and accepted facts about a particular nature of natural ingredient found in cannabis and other botanicals.
Any recommendations accepted by a purchaser/patient/nurse are accepted entirely at the purchaser’s risk. Nurses For Safe Access accepts no responsibility for correct or incorrect use of professional information given or products utilized.
Illegal Drugs
Nurses For Safe Access does not sell, buy, possess, or distribute drugs of any kind. Nurses For Safe Access sells independent nurse advocate consulting services and agricultural products regarding the legal, medicinal use of medical cannabinoids according to California’s legislation. Nurses For Safe Access works with independent nurse advocates with various specialties and connects patients to them via our scheduling system.
Federal Law
Although many states have legalized cannabinoids for medical or recreational use, all possession, sale, and transportation of cannabis is still illegal under federal law. (http://www.justice.gov/iso/opa/resources/3052013829132756857467.pdf)and February 2014 (http://www.justice.gov/usao/waw/press/newsblog.pdf) makes clear that the federal government is prioritizing investigation and prosecution of marijuana use and possession that is illegal under both state and federal law. While Nurses For Safe Access believes the risk of federal prosecution for those closely following state law is questionable with the Trump administration, we have no control over federal enforcement and Department of Justice guidelines can change without warning. Nurses For Safe Access makes no warranty regarding the unique legal risks associated with cannabis education, cannabis dosing, cultivation, or dispensing even when done in accordance with state law. Moreover, nurses and patients alike need to continually stay educated about our ever-changing cannabis laws: federally, sate-by-state, local city, and county laws, as well as the professional code within your state's board of nursing.
State Law
Each state has unique laws regarding the use and cultivation of cannabis. Some states allow only medicinal uses, others permit recreational as well, and many ban cannabis outright. Nurses For Safe Access provides services only to clients operating in full compliance with existing state cannabis law in California. Our services are designed to educate and assist licensed medical cannabis patients.
No Legal Advice
Nurses For Safe Access is not a law firm and does not provide legal advice. No use of services or communication with any individual or legal firm may create an attorney client relationship. Nurses For Safe Access recommends that you consult an attorney regarding any questions about legal risk associated with advocating, utilizing, growing, and dispensing cannabis and/or cannabis products.
Payment Processors
Nurses For Safe Access is in no way associated with PayPal, Square, or any other payment processor. The information provided to these entities is not under the control of Nurses For Safe Access. We are not responsible or liable for any problems, damages, charges, or losses that may occur with regard to a member’s direct association with PayPal or other payment source and any other aspects of their account.
Refunds
Nurses For Safe Access will not issue any refunds for services or items purchased or for failure to cancel services unless otherwise specified in the contract for services with individual clients.
No Warranty
All information and services provided by Nurses For Safe Access on the site or in our clinics are on an “as is” and “as available” basis. Your use of our site and the information/forms contained within the site are done at your sole risk. Nurses For Safe Access expressly disclaims all warranties of any kind. Because some jurisdictions do not permit exclusion of certain warranties, some of these exclusions may or may not apply to you.
Miscellaneous Disclosure
Dosing varies from each patient and is dependent upon individual idiosyncrasies, medical condition, medications, age, weight, and other various factors. Nurses For Safe Access strongly recommends each client obtain a suggested dosing protocol provided by your independent nurse advocate prior to moving forward with a product order. Nurses For Safe Access is not liable or responsible for clients and nurses that choose to ignore the above disclosures.
